These terms apply when you use the Bibha website, read its content, send us an enquiry or book a demo. Please read them before you use the site.

Acceptance of these terms

These terms of use are a legally binding agreement between you and Bibha. They apply whenever you access or use the website. By using the website, you agree to these terms. If you do not agree, do not use the website.

Our privacy policy explains how we handle personal information, and our cookie policy explains how the website uses cookies and similar technologies.

Who we are

This website is operated by Bibha AI Labs Private Limited (CIN U62099KA2024PTC193869), Villa 92, JRC Palladio, Attibele Road, Billapura, Sarjapura, Anekal, Bangalore 562125, Karnataka, India, the headquarters of Bibha.

Its affiliate Bibha AI Inc., 3790 El Camino Real, Ste 853, Palo Alto, CA 94306, United States, is the Bibha company for the United States.

In these terms, "Bibha", "we", "us" and "our" mean Bibha AI Labs Private Limited and Bibha AI Inc. The section "Governing law and disputes" explains which of them your agreement is with. Both of them can rely on and enforce these terms.

Definitions

In these terms:

  • "website" means the website at bibha.ai in every language version, including its pages, forms and booking flow
  • "content" means everything published on the website, including text, articles, graphics, illustrations, diagrams, animations, logos, design and code
  • "enquiry" means a message or form submission you send to us through the website, including the details you give when you book a demo
  • "you" means the person using the website and, where that person uses it for an organisation, that organisation as well
  • "consumer" means an individual using the website for purposes wholly or mainly outside their trade, business, craft or profession

What these terms cover

These terms cover your use of the website and its content, including sending an enquiry and booking a demo.

These terms do not cover the Bibha platform, the services we deliver, or our products TalentFlow, ReachFar and PeachDesk. Those are governed by their own terms or by the agreement between Bibha and your organisation. Where those terms or that agreement conflict with these terms, they take priority for that product or service.

Who may use the website

The website is intended for business visitors. You must be at least 18 years old to send an enquiry or book a demo.

If you use the website for an organisation, you confirm that you are authorised to accept these terms on its behalf.

Information on this website

The website describes our platform, services and solutions in general terms. It is not an offer or a commitment to supply any product, feature or service. What we provide for a particular workflow, and on what terms, is set out in a written agreement.

Content is general information. It is not legal, financial, technical or other professional advice. Take advice suited to your circumstances before you act on it.

Research digests in News and research are Bibha's independent summaries of research published by others. Bibha is not affiliated with the authors or with the organisations that published the research. Each digest links to the original publication, which is the authoritative source.

Some images on the website are generated with AI, such as the illustrations in News and research articles, whose captions identify them. AI-generated images illustrate ideas; they are not photographs or measured data.

We may update, change or remove content at any time without notice. Content reflects the date it was published or last updated, and we are not obliged to keep it up to date.

Acceptable use

You may use the website to learn about Bibha, to evaluate our platform, services and solutions, and to contact us. When you use the website, you must not:

  • break any applicable law or regulation, or use the website for any fraudulent or deceptive purpose
  • try to gain unauthorised access to the website, its servers or any connected system or account
  • probe, scan or test the website for vulnerabilities, except as allowed under "Security testing and disclosure" below
  • interfere with how the website works, including by overloading it or getting around its security measures, rate limits or submission limits
  • use bots, scrapers, crawlers or other automated means to access, copy or extract content in bulk, except crawlers that follow our robots.txt file and do not degrade the website
  • send automated enquiries or booking requests, or submit enquiries in bulk
  • upload or send viruses, malware or other malicious code
  • send content in an enquiry that is unlawful, defamatory, harassing, threatening, obscene or discriminatory, or that infringes anyone's rights
  • submit false information, impersonate any person or organisation, or send personal information about someone else that you are not allowed to share
  • use the website or the contact details on it to send unsolicited marketing or spam
  • frame the website, or present its content as your own or as endorsed by Bibha

We may investigate suspected breaches of these terms. If we reasonably believe these terms have been broken, we may restrict, suspend or block access to the website, disregard or delete enquiries, and report unlawful activity to the relevant authorities.

Security testing and disclosure

You must not test the security of the website without our permission, except through coordinated disclosure as this section describes.

If you believe you have found a security vulnerability, report it to dpo@bibha.ai. Our security.txt file and Security page list our security contacts.

When you investigate or report a vulnerability, act in good faith: access only what you need to show the issue, do not view, change, keep or share data that is not yours, do not disrupt the website or its users, and give us reasonable time to fix the issue before you tell anyone else about it.

Enquiries and demo bookings

Sending an enquiry or booking a demo does not create a contract or commit either of us to working together. Any work we do for you, and its terms, must be agreed in writing.

Please make sure the information you send is accurate and that you are allowed to share it, and leave confidential information out. An enquiry, or a conversation arranged through the website, does not create any obligation of confidentiality. If you need to share confidential information, ask us to sign a confidentiality agreement first.

This does not affect how we protect personal information. Our privacy policy explains how we handle the information you send.

Demo bookings use a calendar provided by Calendly, which loads only if you allow it in Cookie settings. Calendly's own terms and privacy notice apply to your booking.

Intellectual property

The website and its content belong to Bibha or to those who licensed them to us, and are protected by copyright, trade mark and other intellectual property laws. We reserve all rights not expressly granted in these terms.

The names Bibha, TalentFlow, ReachFar and PeachDesk, and their logos and related marks, are trade marks of Bibha AI Inc. and its affiliates. You must not use them without our prior written permission. Other names and logos on the website belong to their owners.

You may view the website, share links to it, and save or print pages for your own reference or to evaluate Bibha within your organisation. This permission is non-exclusive, non-transferable and revocable. Except as these terms allow or the law permits, you must not copy, adapt, republish, distribute or sell the content, or remove any copyright, trade mark or other notice from it.

If you send us suggestions, ideas or other feedback about the website or Bibha, you grant us a perpetual, irrevocable, worldwide, royalty-free licence to use and incorporate that feedback without obligation to you. This licence does not cover the content of your enquiry, which we use to reply to you and discuss the work you describe.

Third-party websites and services

The website links to our product websites for TalentFlow, ReachFar and PeachDesk, and to websites and services run by others, such as LinkedIn and other social networks, Calendly for demo bookings, and the original publications summarised in News and research. Each has its own terms and privacy policy, which apply when you use it.

A link is not an endorsement. We are not responsible for the content, availability, security or practices of websites and services we do not operate, or for any loss or damage arising from your use of them.

Disclaimer of warranties

The website and its content are provided free of charge, on an "as is" and "as available" basis. To the maximum extent permitted by law, Bibha gives no warranties of any kind, whether express, implied or statutory, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, completeness, and uninterrupted, secure or error-free operation.

We do not promise that the website will always be available, uninterrupted, or free of errors, viruses or other harmful components. We may suspend, change or withdraw the website, or any part of it, at any time.

Some jurisdictions do not allow the exclusion of implied warranties. Where that is the case, these disclaimers apply to the fullest extent the law allows.

Limitation of liability

Nothing in these terms excludes or limits liability that cannot be excluded or limited by law. This includes liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, and, where the law of your country requires it, for intentional or grossly negligent conduct. Nothing in these terms affects your statutory rights as a consumer.

Subject to that, and to the maximum extent permitted by applicable law:

  • Bibha is not liable for any indirect, incidental, special, consequential, punitive or exemplary damages, or for any loss of profits, revenue, business opportunities, data or goodwill
  • Bibha is not liable for any loss or damage arising from your use of, or inability to use, the website, from relying on its content, or from third-party websites and services
  • Bibha's total liability to you for all claims arising out of or relating to these terms or the website, whether in contract, tort (including negligence), breach of statutory duty or otherwise, will not exceed USD 50 or the equivalent in your local currency

These limitations protect Bibha AI Labs Private Limited, Bibha AI Inc. and their officers, directors, employees, agents, affiliates and licensors. They reflect that the website is provided free of charge, and they apply even if a remedy fails of its essential purpose.

Indemnity

If you use the website for an organisation or for business purposes, you will indemnify, defend and hold harmless Bibha and its officers, directors, employees, agents and affiliates against all claims, damages, losses, liabilities, costs and expenses, including reasonable legal fees, arising out of your breach of these terms, your unlawful use of the website, or your infringement of anyone's rights.

We will tell you promptly about any claim covered by this section and cooperate reasonably in its defence. You may control the defence, but you must not settle a claim in a way that imposes obligations on us without our prior written consent. This section does not apply to consumers.

Export controls and sanctions

You must not use the website or send us an enquiry if you are the subject of sanctions imposed by the United Nations, India, the United States, the European Union or the United Kingdom, if you are owned or controlled by someone who is, or if you are located in a country or region where that use is prohibited by law.

You must comply with all export control and sanctions laws that apply to you when you use the website or any information from it.

Governing law and disputes

Which Bibha company your agreement is with, the law that governs these terms, and the courts that decide disputes depend on where you live.

If you live in the United States

If you live in the United States, or use the website for an organisation established there, your agreement is with Bibha AI Inc. These terms, and any dispute arising out of or relating to them or the website, are governed by the laws of the State of California, United States, without regard to its conflict of law principles. Any legal action must be brought exclusively in the state or federal courts located in Santa Clara County, California, and you consent to their personal jurisdiction.

Before filing a claim, you and Bibha AI Inc. will try to resolve the dispute through good faith negotiation for 30 days from written notice of the dispute, and then through mediation by a mutually agreed mediator in Santa Clara County, California, with costs shared equally. If mediation does not resolve the dispute within 60 days of the mediation request, either party may bring proceedings in the courts named above.

If you live anywhere else

If you live outside the United States, or use the website for an organisation established outside the United States, your agreement is with Bibha AI Labs Private Limited. These terms, and any dispute arising out of or relating to them or the website, are governed by the laws of India. The courts of Bangalore, Karnataka, India have exclusive jurisdiction.

Before starting proceedings, please write to us at info@bibha.ai so that we can try to resolve the dispute with you in good faith.

Injunctive relief

Either party may seek injunctive or other equitable relief in any court of competent jurisdiction to prevent actual or threatened infringement of intellectual property rights.

If you are a consumer

If you use the website as a consumer, nothing in this section takes away the protection of the mandatory laws of the country or state where you live, or your right to bring a claim in its courts or before its consumer bodies. In the European Union, the European Economic Area, Switzerland and the United Kingdom, this includes your right to bring proceedings in the courts where you live. The negotiation and mediation steps above apply to you only where those laws allow them.

Changes to these terms

This version of these terms is effective from 1 October 2026.

We may change these terms, for example to reflect changes to the website, our business or the law. We will publish the updated terms on this page and change the date at the top. Changes apply from that date and do not affect anything that happened before it. If you continue to use the website after that date, the updated terms apply to you. If you do not agree to them, stop using the website.

General provisions

Entire agreement

These terms are the entire agreement between you and Bibha about your use of the website, and replace any earlier terms for the website. They do not replace or change any written agreement between Bibha and your organisation.

Assignment

You may not assign or transfer your rights or obligations under these terms without our prior written consent. We may assign or transfer ours, including to an affiliate or as part of a merger, acquisition, restructuring or sale of assets, provided this does not reduce your rights under these terms.

Severability

If a court or authority finds any part of these terms invalid or unenforceable, that part will be changed to the minimum extent needed or removed, and the rest of these terms will remain in full force.

Waiver

If we do not enforce a right or provision, or delay doing so, that is not a waiver. A waiver is effective only if it is in writing and signed by an authorised representative of Bibha.

Who can enforce these terms

Bibha AI Labs Private Limited and Bibha AI Inc. can each rely on and enforce these terms. No one else has any right to enforce them.

Events outside our control

We are not liable for any failure or delay caused by circumstances beyond our reasonable control, including natural disasters, epidemics, war, terrorism, civil unrest, government action, power or telecommunications failures, cyberattacks, labour disputes and failures of third-party providers.

Language

These terms are written in English. Any translation, including the German version, is provided for convenience only. If a translation differs from the English version, the English version prevails, unless the mandatory law of your country requires otherwise.
